Waiver of Liability and Assumption of All Risks!
Discover
Vietnam LLC, their employees, owners, affiliates, officers, directors,
successors, agents, and assigns, does not own or operate any entity which
provides , or is to provide, goods and services for your trip, including lodging
facilities, transportation companies, food services providers, equipment
supplies, and sightseeing guides. As
a result, Discover Vietnam LLC, is not liable for any negligent or willful act
or failure to act of such third person, or of any other third party
In
addition, I acknowledge that I have voluntarily applied to participate in the
trip designated on this application. I
am voluntarily participating in this trip with the knowledge of the numerous
risks and dangers involved, including but not limited to:
negligence in the conduct or arrangement of this trip in any respect from
inception to completion, negligence with regard to bicycle maintenance,
in the maintenance or operation of any van, bus, or other motor vehicle
utilized to transport passengers, etc.; physical exertion for which I am not
prepared; forces of nature; transportation failures whether by airplane, train,
auto, boat, canoe, kayak, horseback
or other animal, by foot, or by any other conveyance;
consumption of alcoholic beverages;
risks associated with food or impure water; civil unrest; terrorism;
criminal activity; dangers
associated with wild or other animals; breakdown
or failure of bicycles or other equipment;
accident or illness without access to means of rapid evacuation or
availability of medical supplies or services;
the adequacy of medical attention once provided; and stolen, lost, or
misplaced luggage or property. I
acknowledge that the enjoyment and
excitement of adventure travel is derived in part from the inherent risks
incurred by travel and activity beyond the accepted safety of life at home or
work and that these inherent risks contribute to such enjoyment
and excitement, being the reason for my participation. I
HEREBY AGREE TO BE RESPONSIBLE FOR MY OWN WELFARE AND ACCEPT ANY AND ALL RISKS OF DELAY, UNANTICIPATED EVENTS,
INCONVENIENCE, ILLNESS, INJURY, EMOTIONAL TRAUMA OR DEATH. I
acknowledge that participation in a Discover Vietnam, LLC tour is based upon my
execution of this Release of Liability and
Assumption of All Risks. I hereby
RELEASE AND DISCHARGE FOREVER DISCOVER VIETNAM, LLC FROM AND AGAINST ANY AND ALL
LIABILITY ARISING FROM MY PARTICIPATION IN THE TRIP.
I agree that this release shall be legally binding upon me personally,
all members of my family, and all minors traveling with me, my and their heirs,
successors, assigns, and legal representatives, it being my attention to fully
assume all the risks associated with this trip and release Discover Vietnam, LLC
from any and all liabilities to the maximum extent permitted by law. Other Important
Information Tour
Cancellation:
I understand that in the event I need to cancel my participation in the
tour, the following policy applies. I
must provide written notice of cancellation by letter, E-mail or Fax to be
received by Discover Vietnam . If
my written notice of cancellation is received before 60 days of the start of the
tour I will receive a full refund of monies paid, minus a $200 cancellation fee. If my written notice is received by Discover Vietnam,
LLC between 31 to 60 days before the start of the tour, I will lose 50% of the
tour money paid. If my written
notice is received 30 days or less before the start of the tour, there is no
refund of any tour monies paid. I
understand that Discover Vietnam, LLC has recommended to me that I strongly
consider Travel and Cancellation Insurance in the event unforeseen
circumstances, such as illness or other problems, require me to cancel or leave
the tour early. I also understand
that if Discover Vietnam, LLC should cancel the tour, I will be given a full
refund of all monies paid to Discover Vietnam, LLC. Refuse
and Removal: I
understand that Discover Vietnam, LLC reserves the right to refuse as a trip
participant, or remove from a trip, any person it judges to be incapable of
meeting the rigors and requirements of participating in the activities, or who
it determines to distract from the enjoyment of the trip by others. I agree to follow all written and verbal rules of safety
presented to me by Discover Vietnam, LLC. Single
Room Supplement:
Discover Vietnam, LLC land package tour prices are based on double occupancy. I
understand, if I request a room by myself, I will be charged the appropriate
supplement. If I travel alone and I
request a roommate, Discover Vietnam, LLC will make every effort to match me up
with a roommate of the same gender. I understand, if there is no one with whom I
can share a room, I will be charged the full single room supplement. Also, if a
single room must be assigned to me due to last minute
roommate cancellation or incompatibility, or for any
other reason, the single room charge, or applicable prorated charge, will be
assessed. Photographic
Records: I
understand that Discover Vietnam, LLC reserves the right to take photographic or
film images of any of its tours and hereby agree that Discover Vietnam, LLC may
use such photographic or film records for promotional purposes.
The same applies to photographic or film images which I provide to
Discover Vietnam, LLC voluntarily. I
hereby assign all right, title, and interest I may have here in or to any and
all media in which my name or likeness might be used by Discover Vietnam, LLC. I
have carefully read and fully understand the contents and legal ramifications of
the Release of Liability and Assumption of All Risk agreement, as well as
the conditions as stated in the Other
